These terms apply to all services purchased through this site from Tommaso Bertocchi (“I”, “me”) by a business customer (“you”).

1. Business customers only

Services are offered only to businesses and professionals acting in the course of their business, not to consumers.

2. Scope

The scope of each project is agreed in writing (email is enough). Work outside the agreed scope is quoted separately before it starts.

3. Payment

  • Audit: paid in full at purchase.
  • Starter and Production builds: 50% deposit at purchase through Stripe. The remaining 50% is invoiced through Stripe at delivery and is due within 7 days. Source code and repository access are transferred after the final payment.
  • Maintenance: billed monthly in advance, cancel anytime; cancellation takes effect at the end of the paid month.

Prices are in USD.

4. Refunds

  • If, after the written scope, either of us decides the project is not a good fit, the deposit is refunded in full.
  • Once work has started under an agreed scope, the deposit is non-refundable.
  • An audit is refundable in full until I start the review.

5. Delivery and revisions

Delivery times are estimates that start after the written scope is agreed and after you provide the access and information I need. Each build includes two rounds of revisions on the agreed scope, and 14 days of bug fixes after delivery.

6. Ownership

Once paid in full, you own the code I write specifically for your project. I may reuse general techniques, open-source components and non-confidential know-how. I won’t publish your code or name you as a client without your permission.

7. Confidentiality and access

I keep your confidential information and credentials confidential and use them only for the project. You are responsible for granting me only the access I need and for revoking it at the end of the project.

8. AI systems

MCP servers are used by AI models that I don’t control. I don’t guarantee the behavior, accuracy or availability of third-party AI models, clients or services. You are responsible for how the server is used in your product and for reviewing actions taken by agents.

9. Liability

To the maximum extent permitted by law, my total liability for any claim related to a project is limited to the amount you paid for that project. I’m not liable for indirect or consequential damages, including lost profits or data.

10. Governing law

These terms are governed by Italian law.
